Terms and Conditions

1.0 Definitions

For the purposes of these Terms and Conditions, the following definitions will apply:

Services – Setting up and flying remotely piloted aircraft systems for the purpose of aerial photography, videography and / or data collection. These will include any investigative work, preparatory work and post processing work required to complete the Brief agreed with the Client.

Imagery – Aerial still photography, videos and data collected during flights while engaged by the client.

The Client, The Customer, You or variations thereof – Person, persons or company engaging the services of Shoreside Solutions Ltd.

Shoreside Aerial is the trading name for Shoreside Solutions Ltd. Registered office: 145-157 St. John Street, London, EC1V 4PY. Company Registration Number: 8531445.

Shoreside Aerial, Shoreside Solutions, Shoreside, We, Us or variations thereof – Shoreside Solution Ltd.

Brief – Information provided by the client to allow Shoreside Aerial to carry out the services.

Authorities include but are not limited to – Civil Aviation Authority, Air Traffic Control, Government agencies, Police, Fire, Helicopter Emergency Services, Local Authorities and Ministry of Defence.

2.0 Title and Copyright

2.1 The title of the imagery supplied by Shoreside Aerial will remain the property of Shoreside Aerial until the payment is received in full.

2.2 Full personal reproduction Rights of the commissioned material passes to the Client upon settlement of the final invoice. This allows reproduction for all uses stated on the quotation from Shoreside Aerial. By default and in the absence of any stated use, this will be General Marketing.

2.3 Copyright of imagery will remain with Shoreside Aerial. Shoreside Aerial reserve the right to use all imagery for promotional purposes without further recall to the client, unless the client has requested in writing at the time of booking that the images should not be used for such purposes.

3.0 Quotations

3.1 Written quotations are valid for 30 days and will be supplied for all work on receipt of a clear and accurate written brief from the client. Written briefs are required to ensure photographic objectives are well defined for both the Client and Shoreside Aerial. The brief may include but is not limited to: full postal address with postcode, maps, site plans with boundaries, OS Grid references and any other equipment required to identify the site from the air.

3.2 The quotation and fee will include the services and imagery as described in the brief. Mileage may be charged separately but We will inform You if this is to be an additional cost.

3.3 Shoreside Aerial will carry out our own risk assessments as we deem necessary. If the Client requires an additional risk assessment, We reserve the right to invoice the Client for their assessment to be completed.

3.4 If a site survey is required prior to the quotation, the cost will be agreed and invoiced in advance.

4. Payment

4.1 All invoices to be paid in full upon completion of the project. A deposit or 30% of the quoted fee is payable upon booking.

4.2 Payment may be made by BACS transfer, cash or cheque made payable to Shoreside Solutions Ltd (payment being deemed to be made when the cheque has cleared). A £25 charge will be added to the invoice for any returned cheques.

4.3 There is no VAT payable on our services.

5. Consent to carry out services

5.1 Shoreside Aerial will have obtained all necessary permissions from the relevant statutory authorities prior to the flight commencing.

5.2 Shoreside Aerial will only carry out the brief from the Client within the limitations of the consents and restrictions from the authorities. This may include height restrictions, time/day of flights and or any other restrictions imposed.

5.3 Shoreside Aerial will only carry out the flights once the Client, representative or their agent, being properly authorised to do so, has emailed This email address is being protected from spambots. You need JavaScript enabled to view it. giving permission for the flight, including the take-off and landing , to take place and accepting and agreeing to the Terms and Conditions. Should the Client subsequently refuse to consent to the flight, the client will be liable for the full cost of the quotation plus any incidental expenses at cost not included in the quotation.

5.4 The Client further agrees to indemnify Shoreside Aerial against all costs, including but not limited to legal costs which Shoreside Aerial may incur as a result of the Client failing to obtain the required consents or the client not being authorised to give consent.

6. Limitation of Liability, Force Majeure, Weather, Act of God and other constraints

6.1 Shoreside Aerial have no obligation to carry out the services at the time or date agrees although every effort will be made to do so.

6.2 Shoreside Aerial does not accept liability for errors resulting from incomplete or inaccurate instructions from the Client’s Brief, nor for delays or restrictions caused by authorities including but not limited to Air Traffic Control, CAA or the Police.

6.3 Shoreside Aerial will endeavour to fulfil the contract to carry out the services as required by the Client’s Brief. However, due to the nature of these services it may not be possible to carry out the flights as per the Brief and as consequence Shoreside Aerial will not be held liable for any missed deadlines or consequences resulting from Shoreside Aerial being unable to carry out the services.

6.4 In any event, the total liability of Shoreside Aerial will be limited to the total value of the contract. No liability is accepted for indirect or consequential loss.

6.5 Shoreside Aerial accept no liability for delay or non-fulfilment of any term of the contract caused wholly or in part by “force majeure” which expression shall be deemed to include war, strikes, lockouts, accidents, fire, scarcity of materials or any other cause or causes not within Our control.

7. Cancelation

7.1 If Shoreside Aerial are unable to fly due to adverse weather conditions or mechanical failure, and the photoshoot cannot be rescheduled, Shoreside Aerial will refund for any flying time that day. Costs incurred prior to the photoshoot day such as paid for site visits and meetings remain due for payment.

7.2 If Shoreside Aerial cannot fly due to reasons which only become evident on site or for reasons that Shoreside Aerial were not advised of beforehand, the full cost will remain due for payment.

7.3 If the Client cancels due to no longer requiring Our services, the 30% deposit will not be refunded unless by a pre-agreement. If additional costs have been incurred, these will also have to be met by the Client.

8. Security

8.1 Shoreside Aerial will not knowingly seek to obtain imagery by covert means.

8.2 All flights will be carried out on the understanding that the Client or their representative or agent as shown on the booking form has full permission to obtain the imagery taken as part of the services provided by Shoreside Aerial.

8.3 The Client will be responsible for any damages or costs arising from actions taken against Shoreside Aerial by any third party as a result of Shoreside Aerial fulfilling the Client’s brief.

8.4 It is the responsibility of the Client to make Shoreside Aerial aware of any security sensitive imagery taken as part of the services that should not be made public. This information must be included in the client’s brief prior to any flights.

9. Quality

9.1 Shoreside Aerial will make every effort to ensure the quality of the images is suitable for the intended purpose of the Client as described in the Brief.

9.2 Shireside Aerial will not be held responsible for the quality of imagery due to adverse weather conditions.

9.3 Shoreside Aerial will offer to reschedule the flight if Shoreside Aerial considers the weather conditions are not suited to achieve the imagery the Client has outlined in the Brief.

10. General Terms

10.1 Any disputes will be covered by the law of England and Wales.

10.2 These terms and conditions are subject to change without notice.
